So says a unanimous three-judge panel of the U.S. Court of Appeals for the Second Circuit today, in rejecting a state prisoner's habeas corpus appeal challenging as unconstitutionally vague a New York State statute that allows a jury to presume a kidnapping victim dead if the victim hasn't been heard from since the time of abduction.
